The Second Circuit Court of Appeals ruled that Miranda warnings and warrants for searches of your property and possessions do not apply to American citizens who are living abroad.

The fourth amendment of our constitution says that we are protected from warrantless searches and seizures by the US government.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.


Additionally the fifth amendment covers our Miranda rights.
o person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


This 3 panel appeals court has ruled that our constitution does not protect our rights if we are traveling over seas. They ruled that any US government agency can search your hotel, property or belongings without a warrant and arrest you without informing you of your rights.

Americans should be treated as Americans regardless of where we live. Just because a US citizen is living in France for 3 months does not mean they are not a citizen. The government can not arbitrarily decide that your rights under our constitution end when you are off US soil. We are always Americans whether we live in Arizona or South Africa.

Hopefully the Supreme Court hears this case and over turns it.
